This Acceptable Use Policy is used in conjunction with the terms of your service agreement. Violating any of these policies grants Naboso Technology, LLC the authority to take action to restrict or terminate your access to Naboso Technology LLC Services. We reserve the right, at our discretion, to update or revise this policy, any other policy or statement on any Naboso Technology LLC website, and any product offerings or programs described on any Naboso Technology LLC website. Naboso Technology LLC disclaims, to the maximum extent permitted by law, all warranties, representations or other endorsements, express or implied, with regard to the information accessed from, or through, this service, the systems which provide it and the Internet, including all warranties or merchantability or fitness for a particular use, or non-infringement of any third-party rights. Naboso Technology LLC does not assume any liability fro the completeness, accuracy or usefulness of any information disclosed or materials accessed. In no event shall Naboso Technology LLC (or any persons or entities related thereto) be liable for any special, indirect, or consequential damages associated with or arising from use of this service in any way, including any loss of use, data or profits, regardless of the form of action.

Lawful Use

You must use this site and the Naboso Technology LLC services in accordance with the terms of this policy and your Naboso Technology LLCS services in accordance with the terms of this policy and your Naboso Technology LLC Service Agreement, and in accordance with all federal, state and local laws, ordinances, or regulations.

User Conduct, Prohibited Or Unlawful Use

In order to maintain an informative and valuable service that meets the needs of the users of this site and Naboso Technology LLC Services, the following rules have been established to protect against abuse. Use of this site or the Naboso Technology LLC Services for any purpose that is unlawful or in any manner which could damage, disable, overburden or impair the operation of this site, or Naboso Technology LLC Services or any other party's use or enjoyment of this site or Naboso Technology LLC Services, is strictly prohibited. Additionally, you may not, by use of any Naboso Technology LLC Service or another service, upload, post or otherwise distribute or facilitate distribution of any content, including text, communications, software, images, sounds, data, or other information that: Is unlawful, threatening, abusive, harassing, libelous, defamatory, obscene, deceptive, fraudulent, invasive of another's privacy, tortious, pornographic or inaccurate; Victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, disability or any other reason; Constitutes unsolicited duplicative e-mail (commercial or otherwise); This prohibition extends to the sending of unsolicited mass e-mailings from another service which in any way implicates the use of this site or Naboso Technology LLC equipment or any Naboso Technology LLC e-mail address. A communication is unsolicited if it is posted in violation of a newsgroup charter, or if it is sent to a recipient who has not requested receipt of communications. Contains viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer. Your participation in online communication is not edited, censored or otherwise controlled by Naboso Technology LLC However, Naboso Technology LLC reserves the right to monitor content on this site and Naboso Technology LLC Services and to remove content which Naboso Technology LLC, in its sole discretion, determines to be harmful, offensive, or otherwise in violation of this Acceptable Use Policy.

Intellectual Property Rights

You acknowledge and agree that copyrights, trademarks, service marks, patents, trade secrets, and other proprietary rights and laws protect all content and materials available on this site. Nothing on any Naboso Technology LLC website shall be interpreted or implied in such a way as conferring any license or right to any intellectual property rights or license to any intellectual property, content, technology, system, process, or related material belonging to Naboso Technology LLC by virtue of it being displayed or made accessible on any Naboso Technology LLC website. Except as expressly authorized by Naboso Technology LLC, you agree not to use this site or the Naboso Technology LLC Services in any manner that would infringe, violate, dilute or misappropriate any such rights, with respect to any material, which you access or receive through this site or the Naboso Technology LLC Services. If you use a domain name in connection with Naboso Technology LLC or any webhosting service, you must not use that domain name in violation or any trademark, service mark, or similar rights of any third party.

User's Grant of Limited License

By posting or submitting content to any Naboso Technology LLC website, you: Grant Naboso Technology LLC the right to use, reproduce, display, adapt, modify, distribute and have distributed the content in any form, anywhere and for any purpose, subject to the Naboso Technology LLC Privacy Policy, which is incorporated in and made a part of this Policy; and, Warrant and represent that you own or otherwise control all of the rights to the content and that public posting and use of your content by Naboso Technology LLC will not infringe or violate the rights of any third party.

Dial-up Use Rules

When accessing Naboso Technology LLC Services via dial-up, you must not use Naboso Technology LLC Services to operate server programs, including but not limited to, mail, IRC, ftp or web servers. You must not use dial-up access on a standby or inactive basis in order to maintain a connection. The use of automated electronic or mechanical processes to maintain a constant connection, such as the use of an auto-dialer, persistent checking of e-mail or "pinging" the host, are prohibited.

Termination

Naboso Technology LLC reserves the right, in its sole discretion, to terminate or temporarily suspend your access to Naboso Technology LLC Services or any portion thereof at any time, without notice, in the event you violate any terms, conditions or notices contained in this Acceptable Use Policy. In the event of such termination, you will not receive any refund or credit for the amounts paid to Naboso Technology LLC. Additionally, termination for violation of this policy may also result in termination charges being assessed against you. Naboso Technology LLC will investigate incidents involving such violations and may involve and will cooperate with law enforcement officials if a criminal violation is suspected. Any such violation may result in criminal and civil liability. Generally, any complaints you may have regarding unlawful use, e-mail abuse, copyright infringement or system or network security issues should be sent to orders@nabosotechnology.com

Mobile Terms of Service

The Naboso Technology mobile message service (the "Service") is operated by Naboso Technology (“Naboso Technology”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Naboso Technology’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Naboso Technology through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Naboso Technology. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18775861842 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Naboso Technology mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
